Employers often realize too late that they have failed to comply with California laws on bonus and commission pay.  Mistakes can be costly for employers and for employees whose pay may be withheld by mistake.  This seminar will highlight both common mistakes and complex problem areas for bonuses and commissions and provide practical solutions and forms for best practices.

Topics will include:

  • California’s requirement of written commission contracts
  • Best practices for drafting commission plans and bonus plans
  • When commissions and bonuses become vested and not forfeitable (i.e. earned wages)
  • Handling chargebacks, cancelled sales, and avoiding wage forfeiture
  • Understanding metrics-based deferred compensation in bonuses
  • Common mistakes with sign-on bonuses, transition bonuses and retention bonuses
  • Narrow overtime exemptions for commission pay
  • Accounting for bonus/commission pay in non-exempt employees' overtime
  • Avoiding traps when terminating employees before a bonus or commission is paid
  • When former employees may be entitled to receive a commission or bonus after termination
  • Hypotheticals involving recurring types of bonus/commission disputes
