To acquaint any attorney new (or more experienced) to the civil practice arena with the basic (and critical) information necessary to determine the appropriate ADR for their case from the perspective of a plaintiff or defendant.

The areas to be covered by the panel will include:

  • Preparing the Complaint Properly (prior investigation, clarity of statement of facts, setting out injury & value)
  • Filing the Complaint (service, response, discovery, collection of relevant documents, notice of first case management conference)
  • Preparation Prior to Case Management Conference (requirements of court for ADR)
  • Determining Which Rule 4 ADR Option is Best for Facts/Value of Case
  • Discussion of Options with Client, including Costs & Confidentiality
  • Selection of Neutral (who conducts Rule 4 ADR; current list of judicial arbitrators)

The topic will be discussed by a highly qualified group of panelists including two experienced civil practitioners with ADR experience and one as an ADR neutral, an experienced Superior Court Judge, the Santa Clara County Superior Court's ADR Administrator and the Co-chairs of the Barristers' Committee as moderators.
