Every employment case involves tax issues. Consider wage and non-wage characterization, legal fee tax treatment, and Form 1099 reporting tricks and traps. The exclusion for physical injury and physical sickness damages is also often in question. Rob Wood will discuss these tax issues, including how to allocate damages in a settlement agreement, what factors the IRS considers in determining the tax treatment of a settlement, and the consequences of misallocating settlement proceeds.
