This brown bag will focus first on the more recent decisions addressing the issue of compensable time. What is an employer’s responsibility with regard to reporting time, call-in time, break periods, travel time, de minimis time, and sleep time? The brown bag will also focus on the published cases that have applied Dynamex v. Superior Court, and describe the circumstances in which the courts have not applied the general rule of “all workers are now employees.” This discussion will emphasize both plaintiff and defense perspectives for these issues of hours worked and independent contractor (or not) arrangements. Both speakers are experienced litigators of wage-hour issues under both California and federal law, and will offer a question and answer session. Be certain to join fellow L&E section members for the annual Fall Social, to be held at 6 p.m. in the 4th floor patio at 10 Almaden immediately following the brown bag.
