Description:

 

In these unprecedented times, many local and state governments have taken various steps to protect tenants, in some instances including commercial tenants, from eviction.


In March, Santa Clara County issued a countywide eviction moratorium.  The order provides protections for both residential and commercial small business tenants.  Not only are failure to pay rent evictions prohibited, “no fault” evictions, such as ones where the owner is intending to move into the property or taking the property off the market, are prohibited during the prescribed timeframe.


In April, the Judicial Council issued eleven Emergency Rules of Court. Rule 1 addressed Unlawful Detainers and Rule 2 addressed Judicial Foreclosures.  


This Brown Bag Presentation is intended to give practitioners the legal update, as well as the practical implications for landlords and tenants at this time.  Additionally, some time will be reserved to discuss various options for Landlords and Tenants to work through lease disruption.
