Are you getting the most out of mediation?

Mediation is now the preferred means of settling cases. Despite its popularity, however, both experienced litigators and newer lawyers make costly mistakes throughout the mediation process. This seminar was developed by experienced mediators and advocates to guide practitioners to an advanced level of mediation skills. The program includes a full unit of ethics.

This seminar will cover:
Key elements of client preparation – what to do and what to avoid.
Preparing a persuasive and helpful mediation brief.
Preparing for a class action mediation.
Effectively using the pre-mediation telephone call.
How to help the mediator help you.
“Oversharing” - What not to tell the mediator.
•    Understanding timing and use of “offers” to move the negotiation process forward: the initial offer and counter offer; brackets and counter brackets; last, best and final offers.
Ethics in mediation? Yes indeed! Know the rules governing candor and honesty; prohibited settlement terms; confidentiality and more. A full hour of your ethical responsibilities before, during and after mediation.
